These Terms and Conditions ("Terms") govern your use of the Performance Media Pros website (the "Site") and the marketing services we provide (the "Services"). Performance Media Pros is operated by Vijay Sujanani ("we," "us," "our"). By using the Site or engaging the Services, you agree to these Terms.
We provide digital marketing services including paid media management (Google and Meta), conversion tracking and measurement, funnel and creative strategy, and related consulting. The specific scope, fees, and duration of any engagement are set out in the proposal, agreement, or written communication agreed with each client, which together with these Terms forms the contract between us.
Marketing performance depends on factors outside any operator's control, including platform behaviour, market conditions, your offer, pricing, fulfilment, and sales process. Case studies and figures on this Site are real historical results from specific client accounts with scope stated plainly; they are illustrations of past work, not promises or guarantees of future performance, revenue, or return on ad spend for your business.
Service fees, billing frequency, and payment methods are set out in each engagement. Unless otherwise agreed, fees are payable in advance for each engagement period and engagements after any initial term continue month to month. Refunds are governed by our Refund Policy.
Campaign structures, creative assets, and reports produced for a client under a paid engagement belong to that client once fees are paid, except for our pre-existing methods, frameworks, templates, and know-how, which remain ours. Site content, including case studies and copy, belongs to us and may not be reproduced without permission.
Each party will keep the other's non-public business information confidential and use it only for the engagement. We may reference anonymised or agreed results in case studies; if you prefer your results not be referenced, tell us in writing and we will honour it.
By submitting your contact details you consent to be contacted about your enquiry by email or phone. If you separately opt in to SMS, our messaging program is described in the Privacy Policy: message frequency varies, message and data rates may apply, reply STOP to opt out and HELP for help. Consent to receive text messages is not a condition of purchase. Mobile opt-in data is never shared with third parties for marketing purposes.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, loss of profits, or loss of data arising from the Site or Services. Our total aggregate liability for any claim relating to the Services is limited to the service fees paid by you in the three (3) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
The Services involve third-party platforms (Google, Meta, and others) whose policies, pricing, and behaviour change without notice. We are not responsible for platform outages, policy decisions, account restrictions imposed by platforms, or changes in platform performance, though we work diligently within platform rules to prevent and resolve such issues.
Either party may end a month-to-month engagement with written notice before the next billing cycle, as detailed in the Refund Policy. We may suspend or terminate Services for non-payment or unlawful use. Sections 2, 5, 6, and 8 survive termination.
These Terms are governed by the laws of India, and the courts of Hyderabad, Telangana shall have exclusive jurisdiction, unless a signed client agreement specifies otherwise.
